1. Acceptance of Terms

By accessing, browsing, or using the Trenovaxia website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Trenovaxia ("Company", "we", "our", or "us"), a premium electric bike manufacturer and seller operating from 42 Bree Street, Cape Town Central, Cape Town, 8001, South Africa.

If you do not agree to these Terms, you must immediately cease using the Trenovaxia website and services. Your continued use of the website after any modifications to these Terms constitutes acceptance of the updated Terms.

These Terms are governed by and shall be construed in accordance with the laws of the Republic of South Africa, including but not limited to the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), and the Protection of Personal Information Act 4 of 2013 (POPIA).

2. Description of Services

Trenovaxia provides the following products and services through our website and physical showroom:

• Design, manufacture, and sale of premium electric bicycles (e-bikes)
• Custom e-bike configuration and build services
• E-bike test ride experiences at our Cape Town showroom
• Battery upgrade and replacement services
• Maintenance, servicing, and repair packages for Trenovaxia e-bikes
• Smart app setup and digital connectivity integration
• Eco-riding consultations and route optimisation services
• Accessories and spare parts for Trenovaxia e-bike models

Trenovaxia reserves the right to modify, suspend, or discontinue any product, service, or feature at any time without prior notice. Product specifications, colours, and pricing displayed on the website are subject to change and may vary from physical products.

3. Eligibility

To use the Trenovaxia website and purchase our products or services, you must:

• Be at least 18 years of age or the legal age of majority in your jurisdiction
• Have the legal capacity to enter into binding agreements
• Provide accurate and complete information when making enquiries or purchases
• Not use the website for any unlawful or prohibited purpose

By using our website, you represent and warrant that you meet all eligibility requirements. Trenovaxia reserves the right to refuse service or terminate access to any user who fails to comply with these requirements.

4. Product Information and Pricing

Trenovaxia endeavours to provide accurate product descriptions, specifications, and pricing on our website. However, we do not warrant that all information is complete, current, or error-free. Specifically:

• All prices are displayed in South African Rand (ZAR) and include VAT at the applicable rate unless otherwise stated
• Prices are subject to change without prior notice until an order is confirmed and payment is received
• Product images on the website are for illustrative purposes and may differ slightly from the actual product in colour, finish, or component specification
• E-bike range, speed, and performance figures are based on optimal testing conditions and may vary depending on rider weight, terrain, weather, tyre pressure, and riding style
• Trenovaxia reserves the right to correct any pricing errors discovered after an order is placed and will contact you before processing in such cases

5. Orders and Payment

When placing an order with Trenovaxia, the following conditions apply:

• Submitting an enquiry or order through our website constitutes an offer to purchase, which Trenovaxia may accept or decline at our discretion
• An order is confirmed only upon receipt of payment and issuance of a written order confirmation by Trenovaxia
• Payment may be made via electronic funds transfer (EFT), credit card, or other payment methods as specified at the time of purchase
• Custom build orders may require a non-refundable deposit of up to 50% of the total price, with the balance due before delivery
• All payments are processed securely through our authorised payment partners

6. Delivery and Shipping

Trenovaxia offers delivery of e-bikes and accessories across South Africa under the following conditions:

• Delivery timelines are estimated and not guaranteed; Trenovaxia will communicate any delays promptly
• Standard delivery within the Cape Town metropolitan area is typically completed within 3–5 business days
• National delivery to other South African cities typically takes 5–10 business days
• Custom build orders may take 4–8 weeks from order confirmation to delivery
• Risk of loss or damage passes to the buyer upon delivery to the specified address
• Delivery charges, if applicable, will be communicated before order confirmation
• The buyer is responsible for inspecting the product upon delivery and reporting any visible damage within 48 hours

7. Returns and Refunds

In accordance with the Consumer Protection Act (CPA) of South Africa, Trenovaxia's return and refund policy is as follows:

• You may return a standard (non-custom) Trenovaxia e-bike within 7 days of delivery if the product is unused, in its original packaging, and in resaleable condition
• Custom-built Trenovaxia e-bikes are non-refundable unless they are defective or materially different from the agreed specification
• To initiate a return, contact Trenovaxia at info@trenovaxia.co.za within the applicable return period
• Return shipping costs are the responsibility of the buyer unless the product is defective or incorrectly supplied
• Refunds will be processed within 15 business days of Trenovaxia receiving and inspecting the returned product
• Defective products will be repaired, replaced, or refunded at Trenovaxia's discretion in accordance with the CPA

8. Warranty

All Trenovaxia e-bikes are sold with the following warranty coverage:

• Frame: 3-year warranty against manufacturing defects in materials and workmanship
• Motor: 3-year warranty covering the electric motor and drive system
• Battery: 3-year warranty or 500 charge cycles (whichever occurs first), covering defects that result in capacity below 70% of original specification
• Components: 1-year warranty on brakes, gears, suspension, and electronic components
• Accessories: 6-month warranty on purchased accessories and add-ons

The warranty does not cover damage caused by misuse, neglect, accidents, unauthorised modifications, improper maintenance, normal wear and tear, or use of the e-bike in conditions beyond its specified design parameters. Warranty claims must be submitted to info@trenovaxia.co.za with proof of purchase and a detailed description of the defect.

9. Intellectual Property

All content on the Trenovaxia website — including but not limited to text, graphics, logos, images, icons, product designs, software, and compilations — is the exclusive property of Trenovaxia or its content suppliers and is protected by South African and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, display, perform, transmit, or create derivative works from any content on the Trenovaxia website without our prior written permission. The Trenovaxia name, logo, and all related product names, design marks, and slogans are trademarks of Trenovaxia and may not be used without express written consent.

10. Limitation of Liability

To the maximum extent permitted by applicable South African law:

• Trenovaxia shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, products, or services
• Trenovaxia's total liability for any claim arising under these Terms shall not exceed the amount paid by you for the specific product or service giving rise to the claim
• Trenovaxia is not liable for any injury, damage, or loss resulting from the use or misuse of our e-bikes, including riding in unsafe conditions, exceeding recommended weight limits, or failure to wear appropriate safety equipment
• Trenovaxia does not warrant that the website will be uninterrupted, error-free, or free from viruses or other harmful components

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable South African law, including liability for death or personal injury caused by negligence or fraud.

11. User Conduct

When using the Trenovaxia website, you agree not to:

• Use the website for any unlawful, fraudulent, or malicious purpose
• Attempt to gain unauthorised access to any part of the website, server, or database
• Transmit viruses, malware, or any other harmful code
• Interfere with or disrupt the website's infrastructure or other users' access
• Scrape, harvest, or collect information from the website without permission
• Impersonate any person or entity or misrepresent your affiliation
• Submit false, misleading, or inaccurate information through our contact forms

Trenovaxia reserves the right to restrict or terminate access to the website for any user who violates these conduct rules, without prior notice or liability.

12. Third-Party Links

The Trenovaxia website may contain links to third-party websites or services that are not owned or controlled by Trenovaxia. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that Trenovaxia shall not be responsible or liable for any damage or loss caused by your use of any third-party website or service linked from our website.

13. Indemnification

You agree to indemnify, defend, and hold harmless Trenovaxia, its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the website, your violation of these Terms, your violation of any third-party rights, or any content you submit through our website.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from or relating to these Terms or your use of the Trenovaxia website and services shall be subject to the exclusive jurisdiction of the courts of the Western Cape Division, Cape Town, South Africa.

Before initiating any legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may proceed with formal legal action.

15. Modifications to Terms

Trenovaxia reserves the right to modify, amend, or update these Terms at any time at our sole discretion. Any changes will be effective immediately upon posting the revised Terms on this page with an updated revision date. It is your responsibility to review these Terms periodically. Your continued use of the Trenovaxia website and services after any modifications constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
